أبو رغيف: قرار المحكمة الاتحادية أكد استقلالية ودستورية هيئة الإعلام والاتصالات

أعلن رئيس هيئة الإعلام والاتصالات نوفل أبو رغيف، اليوم الاثنين، أن المحكمة الاتحادية العليا ردّت الدعوى المقامة ضد الهيئة والمتعلقة بعدم دستورية أحكام الأمر 65 لسنة 2004، مؤكداً أن القرار جاء ليؤكد استقلالية ودستورية الهيئة.
وقال أبو رغيف في بيان لهيئة الإعلام والاتصالات تلقته وكالة الأنباء العراقية (واع): إن “المحكمة الاتحادية العليا أصدرت اليوم الاثنين قرارها برد الدعوى المقامة ضد الهيئة والمتعلقة بعدم دستورية أحكام الأمر 65 لسنة 2005، وجاء ردّ الدعوى لعدم تحقق المصلحة المشروعة من إقامتها”.
وأضاف أن “الدعاوى المقامة (ذات الأرقام 323 وموحداتها 333، 334 اتحادية 2025) تضمنت عدة طعون تقدّمت بها وزيرة الاتصالات، شملت طلب الإلغاء والطعن بدستورية عدد من مواد وأقسام الأمر التشريعي رقم 65 لسنة 2004، الذي ينظم عمل المفوضية العراقية للاتصالات والإعلام، وهو الأساس القانوني النافذ الذي تستند إليه الهيئة في مهامها التنظيمية والإشرافية”.
وتابع أن “الطعون المذكورة لم تستند إلى مصلحة مشروعة كافية لتبرير الإبطال أو الطعن في تلك المواد”.
وأشار البيان إلى أن “أبو رغيف ثمّن، باسم الهيئة وتشكيلاتها ومكاتبها ومنتسبيها، قرار المحكمة الاتحادية، معتبراً إياه تأكيداً جديداً على دستورية واستقلالية هيئة الإعلام والاتصالات ومكانتها السيادية، بوصفها مؤسسة اتحادية مستقلة تعمل بموجب القانون، وتضطلع بتنظيم قطاعي الإعلام والاتصالات في العراق وفق المعايير المهنية المعتمدة دولياً، وبما يواكب التطورات المتسارعة في سوق الاتصالات وتكنولوجيا المعلومات”.
